Pharmaceutical Litigation for HPV Vaccines
Anytime you receive a vaccine, it’s meant to prevent—not cause—future health concerns. Lack of due diligence on the manufacturer’s part may mean that your Gardasil HPV vaccine has done more harm than good.
Some patients may experience premature ovarian failure, infertility, and autoimmune disorders without being informed of the risk of these side effects. Dunn Sheehan, LLP can help ease your financial burden by getting you compensation.
Grounds for HPV Vaccine Lawsuits
Human papillomavirus (HPV) is a common type of infection spread through intimate skin to skin contact. There are over 200 strains of HPV, some of which can lead to cancer.
Gardasil, an HPV vaccine, guards against these cancer-causing strains, but several studies have suggested links between this vaccine and serious health conditions. The manufacturer may have overstated the benefits associated with the HPV vaccine while simultaneously failing to warn consumers about these health risks, such as the following:
- Premature ovarian failure (POF)
- Premature ovarian insufficiency (POI)
- Premature menopause
- Infertility
- Postural orthostatic tachycardia syndrome (POTS)
- Autoimmune disorders
- Chronic regional pain syndrome (CRPS)
- Neurological disorders
- Death

Frequently Asked Questions
If you think you and or your child is suffering side effects from an HPV vaccine, you should always seek medical attention first. Early treatment is the most effective treatment. Consult a doctor who can assess you or your child, treat the symptoms, and help establish whether Gardasil might be the cause.
When your condition or symptoms require dramatic medical intervention, and Gardasil seems to be at fault, it’s time to seek legal advice. Reach out to an attorney with pharmaceutical litigation expertise, like the team at Dunn Sheehan. We can help you build a strong case to get restorations from the manufacturer.
The statute of limitations for product liability varies between states, so you should pursue legal action as soon as possible. Some HPV vaccine injury victims are minors. In most places, the statute of limitations doesn’t begin until the minor comes of age, giving you or your child a longer opportunity to file.
Still, time is of the essence. Before pursuing civil litigation, we must file a claim in the U.S. Court of Federal Claims under the National Vaccine Injury Compensation Program (VICP). Only after filing this claim can we pursue further action against the manufacturer.
Not only will early filing help you avoid running out of time, but it will also help you get compensation faster. Reach out to our team to learn whether you have grounds for a Gardasil lawsuit.
Our legal team has handled cases in nearly 40 states and helped drug injury victims across the nation. Your location may affect the timeline of your case, since the statute of limitations may vary according to your state, as described above.
However, our legal team will discuss these factors with you before we start building your HPV vaccine injury case so that you know exactly what to expect.
On June 8, 2006, the FDA approved the first HPV vaccine, Gardasil. Its approval covered the prevention of cervical cancer and pre-cancers caused by HPV types 16 and 18, as well as genital warts and cervical lesions caused by HPV types 6, 11, 16, and 18. Over the next 4 years, the FDA further approved Gardasil for certain vaginal, vulvar, and anal cancers caused by the HPV virus.
On October 16, 2009, the FDA approved a second HPV vaccine, Cervarix, that protected only against cancers and pre-cancers caused by HPV types 16 and 18. Cervarix was discontinued in the United States in 2016.
In December 2014, the FDA approved a third HPV vaccine, Gardasil 9, which prevents against all the aforementioned cancers caused by HPV types 6, 11, 16, and 18, but also HPV types 31, 33, 45, 52, and 58. Gardasil 9 has since fully replaced the original version of Gardasil.
Depending on the date of the injury and the patient’s age when it occurred, our attorneys can help patients pursue financial compensation for severe side effects from Gardasil and Gardasil 9.
